  4. 1.  Apple Computer, Inc. Products Available through the APDA Tools Catalog
  5.  
  6.     a.  Software Products Subject to License
  7.     All Apple Computer, Inc. software products available to you through the
  8.     APDA Tools Catalog are licensed to you, not sold, under the terms of a
  9.     software license that is shipped to you with the product.  By using the
  10.     product, you agree to be bound by the terms of the Apple Software License
  11.     that accompanies the product.  You may obtain a copy of the Apple Software
  12.     License for a given product in advance of ordering the product, or if you
  13.     determine after receiving a product that you do not agree with the terms of
  14.     the accompanying software license, you may return the product to APDA for a
  15.     full refund.

  17.     b.  No Right to Redistribute

  19.     You do not have any right to copy, sublicense or otherwise distribute any
  20.     Apple Computer, Inc. software products that you have ordered from the APDA
  21.     Tools Catalog, except as may be expressly provided in the Apple Software
  22.     License that accompanies the product.  Site and distribution licenses for
  23.     some products are available to qualifying individuals or entities under the
  24.     terms of a separate agreement.  For further information contact:

  31.     c.  Nature of Products

  33.     The APDA Tools Catalog offers its customers a wide range of valuable and
  34.     sophisticated Apple software programming tools.  APDA does not, however,
  35.     provide its customers with technical support for the use of such products.
  36.     When choosing and ordering products through the APDA Tools Catalog,
  37.     moreover, it is extremely important that you understand and consider that
  38.     many of the software products available to you through the APDA Tools
  39.     Catalog are not fully tested.  The untested nature of certain products are
  40.     clearly indicated in the APDA Tools Catalog listing for those products.
  41.     These products may contain errors that could cause system failures or loss
  42.     of data.  Further, some of these products do not come with supporting
  43.     documentation or in some cases the documentation for such a product may be
  44.     incomplete or contain inaccuracies. Therefore you assume all risk of loss
  45.     when using such software products. The license fees for these products
  46.     reflects this allocation of risk.  Consult the Apple Software License for a
  47.     given product for warranty information.

  49. 2. Non-Apple Products Available through the APDA Tools Catalog
  50.  
  51.     Software and other products from third-party manufacturers available
  52.     through the APDA Tools Catalog range from full commercial versions to
  53.     preliminary releases.  License agreements, warranties, commercial
  54.     redistribution policies and other conditions vary with the product and
  55.     are the responsibility of the manufacturer.

  57. 3. Hours of Operation

  59.     Customer Service Representatives will be available for your calls from
  60.     Monday through Friday of each week, 7:00 a.m. to 5:00 p.m., Pacific Time.

  62. 4. Taxes
  63.  
  64.     Apple Computer, Inc. conducts business in every state of the United States.
  65.     This requires us to charge state tax on every domestic order we receive,
  66.     regardless of where the order originated within the United States.

  69. If you are purchasing non Class 1 products, a completed and signed copy of this
  70. form must be on file or accompany the order.  This form need only be completed
  71. and signed once, as it will remain current in our files.
